Breaking Fast Intentionally

If you did not fast during Ramadan out of heedlessness and not because you believed it was permissible, then you have committed a serious major sin by violating the sanctity of Ramadan. Fasting during Ramadan is one of the pillars of Islam. Allah says (interpretation of the meaning):

    “O you who believe! Observing As-Sawm (the fasting) is prescribed for you as it was prescribed for those before you, that you may become Al-Muttaqun (the pious).

    [Observing Sawm (fasts)] for a fixed number of days, but if any of you is ill or on a journey, the same number (should be made up) from other days. And as for those who can fast with difficulty, (e.g. an old man), they have (a choice either to fast or) to feed a Miskin (poor person) (for every day). But whoever does good of his own accord, it is better for him. And that you fast is better for you if only you know.

    The month of Ramadan in which was revealed the Quran, guidance for mankind and clear proofs for the guidance and the criterion (between right and wrong). So whoever of you sights (the crescent on the first night of) the month (of Ramadan i.e. is present at his home), he must observe Sawm (fasts) that month.” [al-Baqarah 2:183-185]

      Expiation for Breaking Fast Intentionally

      You must make up for the days you did not fast. If you had intercourse during the day on those days when you did not fast, you must also offer expiation (kaffarah) for that day, as well as make up the fast. If you had intercourse on two days, you must offer two expiations, as well as making up two days of fasting.

      The expiation is to free a slave; if that is not possible, then you must fast for two consecutive months; if you are unable to do that, then you must feed sixty poor persons with the local staple food. Additionally, you must seek forgiveness from Allah and repent sincerely, resolving not to break your fast during Ramadan again. If you delay making up the fasts until after the following Ramadan, you must also feed one poor person for each of the missed days.

      What to do if you break a makeup fast

      If he breaks his fast – with or without an excuse – he has to make up that day, but he does not have to offer any expiation, because expiation is only required for intercourse during the day in Ramadan.

      If he breaks the fast with no excuse, then he has to repent to Allah for this haram action.

      Ibn Qudamah (4/412) said:

      “If a person starts an obligatory fast, such as making up a missed Ramadan fast, or a fast that he vowed to observe, or an expiatory fast, it is not permissible for him to break the fast. There is no scholarly difference of opinion on this point, praise be to Allah.” 

      Al-Nawawi said in al-Majmu’ (6/383):

      “If a person has intercourse during a fast other than in Ramadan, such as making up a missed fast, or a fast that he vowed to observe, etc., no expiation (kaffarah) is required. This is the view of the majority. Qatadah said: He has to offer expiation if he broke a fast that he was observing to make up for a missed Ramadan fast.”
