hcr Anti-Money Laundering and Refusal of Donations Policy
Introduction
This policy provides guidance to the trustees and staff of Humanity Care Relief (HCR) to ensure the organization meets its legal obligations in countering money laundering. Charities are vulnerable to exploitation by criminals and terrorists. Money laundering is the process by which individuals conceal the origins and ownership of the proceeds from criminal activities. Legal obligations exist for reporting suspected money laundering and the provision of support to terrorist organizations. Failure to meet these obligations can result in criminal sanctions.
Vigilance and Checks
To ensure donations to HCR are from credible sources, the following questions must be addressed before accepting any unusual donation, offer of support, or any donation over £10,000:
Staff members receiving donations must create a written record confirming they have considered the above questions. The record should state that no suspicions of money laundering or other criminal activities have arisen. A copy of this record must be submitted to the Chairman, who will verify that the donated funds have been utilized in accordance with HCR’s objectives and purposes.

Reporting
Suspicions of criminal activity related to any donation, grant, transfer of funds, or third-party contact must be reported to the Trustees. The Trustees are responsible for assessing the risk and determining whether to refer the matter to the relevant authorities. Any suspicion that funds or support are being provided to a terrorist organization should also be reported to the Trustees, who will consider notifying the appropriate authorities.
When offering financial or other support services internationally, a risk analysis should include an assessment of partner relationships, organizational integrity, financial transparency, accountability, project planning, and monitoring. Appropriate risk controls and reduction measures must be in place, particularly in insecure or dangerous regions, including an analysis of political authorities and informal power structures.
Training and Advice
Staff likely to encounter money laundering will receive appropriate training. They should seek advice from Trustees regarding due diligence on individuals and organizations that provide or receive funds or work closely with HCR. This ensures reasonable assurance about the provenance of funds, confidence in the people and organizations HCR works with, and the ability to identify and manage associated risks.
Refusing Donations
Donations made in foreign currencies with conditions for the return of part of the principal sum in sterling should be refused. Donations must also be refused if satisfactory answers to investigations, as outlined in section 2.1, are not received.
In line with HCR’s Code of Behaviour policy, the organization will not accept funds or gifts in kind in circumstances where:
HCR will consider redirecting or returning donations found to have been accepted in breach of this policy. Decisions to refuse any donation must be referred to the Trustees, and any exception to the principles in sections 2 or 5 must be approved by the Trustees.
